1. Agreement to Terms
By accessing or using any Fervour Technologies platform, website, or service ("Services"), you agree to be bound by these Terms. If entering on behalf of a company, you represent authority to bind that entity.
2. Services Description
Fervour provides custom-built Business OS platforms, delivered as perpetual licence or SaaS subscription. Each platform is configured specifically for your organisation on dedicated infrastructure. Scope and deliverables are defined in a separate Statement of Work (SOW).
3. Account & Access
You are responsible for maintaining credential confidentiality and all activities under your account. Notify us immediately of any unauthorised use.
4. Acceptable Use
You agree not to use Services for unlawful purposes, attempt unauthorised access, reverse-engineer the platform, share credentials outside your organisation, upload infringing content, or overburden our infrastructure.
5. Intellectual Property
The Fervour codebase, architecture, and documentation are our intellectual property. Your licence grants usage rights, not ownership. Data you enter remains your property — you retain full ownership of all business data and content.
6. Payment Terms
Terms are specified in your commercial proposal. SaaS invoices are raised monthly or annually in advance. Perpetual licence milestones are defined in the agreement. All amounts are in INR plus GST. Late payments beyond 15 days may result in access suspension.
7. Service Level & Support
Support is provided through a dedicated engineer. Includes bug fixes, minor enhancements, and operational assistance per your AMC or subscription terms.
8. Data Handling
Data is stored on dedicated infrastructure, encrypted at rest and in transit, with role-based access and regular backups. See our Privacy Policy for full details.
9. Termination
Either party may terminate with 30 days written notice. Upon termination: full data export provided (CSV/JSON), data retained 90 days then permanently deleted, outstanding payments become due immediately.
10. Limitation of Liability
Fervour shall not be liable for indirect, incidental, special, or consequential damages. Total liability shall not exceed amounts paid in the 12 months preceding the claim.
11. Governing Law
Governed by laws of India. Disputes subject to exclusive jurisdiction of courts in Vijayawada, Andhra Pradesh.
